We do not warrant that our Services will be uninterrupted or error-free, or that any defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of our Services in terms of their correctness, accuracy, reliability, or otherwise.

Any specific warranties for deliverables will be outlined in the applicable service agreement.

To the maximum extent permitted by applicable law, in no event shall Hexagone, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our Services
• Any conduct or content of any third party on our Services
• Any content obtained from our Services
• Unauthorized access, use, or alteration of your transmissions or content

In any case, our aggregate liability shall not exceed the amount you have paid to us for our Services over the previous 12 months or as specified in the applicable service agreement.

You agree to indemnify, defend, and hold harmless Hexagone, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of our Services
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right
• Any content you submit, post, or transmit through our Services

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our Services shall first be attempted to be resolved through friendly negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the Pakistan Arbitration Association.

The arbitration shall take place in Pakistan, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
